This is great news. Hoping that any sanctions are hard-hitting, rather than a cursory slap on the wrist. As SP says, some businesses could come seriously unstuck if pursued by the authorities.

Unfortunately, there's just too many 'brexit' reports to take in and it makes it difficult to work out what is really happening. That's not to mention that the author of every report has a vested interest one way or the other...

If you look closely, a lot of the media noise and comments coming from Settled pretty much claim it not to be an 'estate agent' but something closer to an FBSO site. So why then when you go on their site is it clear that they're an online agent, listing on Rightmove and Zoopla? I wish firms would stop trying to pull the wool over the eyes of the public.

When is the ASA or NTSEAT going to take these complaints seriously? How many complaints does one firm have to have made against them before they stop getting away with informally resolved cases? Quirk may say that it's just competitors trying to bring him down...even if it is competitors, that doesn't mean that claims aren't misleading or don't have to be changed. This constant bending of the rules must be taken more seriously!

To be fair - any company who are owed thousands of pounds in fees and have contracts with their customers would take this sort of action. It's not particularly desperate or unconventional I don't think.

Well said, Rob. The problem is the Nationwide and Halifax ones seemed to be ingrained in the media reporting, despite the fact that they're not useful nor provide a full picture of the market. The new index is a step forward but its all these leechy, flimsy PR ones that will remain the problem!

I think one of the issues that isn't really touched upon here is the rise of boards being used to advertise fetes and events - these are a bit misleading as it makes you think a house is up for sale when it's not and lots of agents seem to leave these boards up for ages, in some cases even after the event.

Whether you are for or against OTM - I still find commentary from online agents like RQ irrelevant. You're not allowed to join - get over it. After all we've seen of late with the government's targeting of lettings and private landlords - perhaps getting involved with institutional lettings is a smart move for agents - particularly those like EP which don't really have any market share. If what they go ahead with what is alluded to above, it could be a shrewd move.

The problem is the silent majority, Steve. On forums like this you'll only ever hear from the impassioned/or people with an agenda. There are thousands of agents out there that are probably happy with OTM and likewise thousands that are disillusioned. It has almost 6,000 offices on board and that is a fact but I guess in the New Year we will hear more and see some solid figures about growth or lack thereof.... (well, here's to hoping!)

emoov seem to always be in the dock over their advertising. The problem with these 'informal' resolutions is that yes the ad is changed but there is no penalty for misleading advertising. These firms can say whatever they want and then IF it is taken to the ASA it seems in most cases they are just asked to change it rather than have the ad banned or so on. This means misleading ads will continue to appear and firms will continue to take risks with their ads in the knowledge that there is no real punishment. Harder enforcement please ASA!

What a strange report - very stating the obvious to me. 'We have seen Rightmove evolve into the UK property portal of choice' - hasn't it been for the past decade?? 'Rightmove has grabbed market share from OnTheMarket' - didn't RM have all the majority of market share in the first place? 'We see little incentive for estate agents to leave the clear market leader as the shift to online sales continues.' - Sorry what shift to online sales? Still a very small percentage of the market last time anyone checked.

This is ridiculous. Yes they may have said that they are meeting but to me they are just going through the motions. If people keep making complaints they have to make it seem like they are taking them seriously. The section of the letter about trade associations is just protocol - it's official wording which has probably been on the CMA website for months. They are just publicising it to make it seem like they are interested. They got their big scalp recently - and to me this is more about them going after agents and their newspaper advertising than any portal.
