A website which describes itself as a private sellers’ service is getting its properties listed on Rightmove.

Under Frequently Asked Questions on the Mypropertyforsale site, it describes itself as an “online private house selling website” and the following appears:

“Are you an Estate Agent?
No, we are not an estate agent, we are a property selling website that simply allows you to pay a fixed fee that enables you to advertise your property for sale privately on our website.”

Although the site, which says it has 22,000 properties listed, says sellers can list their properties for only £99, it gives no further information.

However, it displays the Rightmove logo on its home page and advertises a virtual agent package. It has some 30 properties listed on Rightmove, ranging from £87,500 to £769,000.

Mypropertyforsale’s virtual agent packages are  £299, which includes a listing on Rightmove and a home visit where photographs, details and measurements are taken. For £429, you also get floorplans.

A Rightmove spokesman said: “We held discussions with this website to verify the nature of their service prior to allowing them to advertise on Rightmove. The properties they advertise on our site are done so via a premium upgrade service.

“For properties advertised in this way the website provides a full estate agency service (valuation, negotiations, etc.) and they are credited estate agents in compliance with PMA.

“We monitor the properties being uploaded by them. We strictly don’t allow private sellers to list on our site.”

Are they not an estate agent? Sounds to me that they do more than just advertise which next question is, are they registered with the OFT, a redress scheme etc? If they are not an estate agent then are not RM in breach and required to suspend mypropertyforsale. Also begs the question of RM aiding and abetting??

To be an agent or not to be.....I am beginning to think the unthinkable.
Will the next stage in agent bashing be for the OFT to obtain legislation to force all property portals to accept advertising from anyone - as part of their view that agents need a 'jolt'?

If they are NOT an EA why do RM allow them to advertise - are RM going to accept responsibilty for any breaches of PMA or EA Act?
