Referral fees paid to estate agents by conveyancing companies could be outlawed, after a decision by the Law Society to lobby for their ban.

Estate agents typically receive £100 for each referral lead that translates into business.

The subject of referral fees was one of the topics probed in the latest research for the OFT. It found that 80% of estate agents recommend solicitors to their clients, and half of these receive fees. Whilst 57% received under £150 per case, 38% claimed to receive between £250 and £299. Over half the agents receiving referral fees told their clients not only of the existence of the referral fee but the amount.

The Law Society Council, which represents all UK solicitors, has adopted a motion to ‘make representations to government and the Legal Services Board that referral fees do not have a place in markets for legal services’ and that they should be banned.

However, because it is the Solicitors Regulatory Authority and not the Law Society which has the power to change the rules, the motion is subject to consultation.

Eddie Goldsmith, senior partner at Goldsmith Williams, said: “It’s difficult to understand why the Law Society wants to ban the payment of referral fees, when it made a policy decision to allow them just five years ago. The existing rules governing fees are clear and require full transparency, and in our experience at Goldsmith Williams, which spans 25 years, we have not received a single client complaint regarding referral fees.”

    "Nature of commerce" - In this industry it is called referral commission in another it is called the mark up to "Retail Value". If you work B2B you always provide a Trade price which allows clients to White Label, become a Reseller etc adding a portion of profit in order to develop the leads. Its just business!

    I suppose Solicitors will now stop adding a bit extra to the bill when they have arranged an indemnity policy

    Another excellent idea, spoken as an agent! There are far too many referal fees in general in this industry to the detriment of the consumer. While they are about it perhaps they should also take a good look at some of the conflicts of interest in large corporate companies, where you get selling agent, buyers conveyancer, mortgage broker and surveyor all working for the same firm. That just can't be right!!

    I read this as solicitors wanting to go back to the old days when I started in agency 25 years ago when vendors just went direct to them, and if they were referred by an agent they were taken to lunch or got wine at Xmas for their trouble. It seems that solicitors want to alienate themselves from agents and conveyancing firms, I think they should remember who has kept them in business for the last x amount of years !!

    Good News! I am fed up with agents trying to undercut commissions safe in the knowledge that they can top up income through referral fees, HIPs etc.

    In reality, they are cheating their own staff as seldom to the negs get a cut of these kick backs. All fees should be inclusive and transparent. How many agents actually disclose these 'secret fees?'
