Agents' Mutual one other portal hearing: no immediate decision

The Competition Appeals Tribunal hearing between Agents’ Mutual and Connells-owned agency Gascoigne Halman is to be concluded on Monday - but the result may not be known for some time.

The long-running case - its first day was February 3 - is hearing legal arguments in private today and will hear final submissions from both sides in public at the start of next week.

The three-man tribunal will then consider and the chairman will then write a judgement, to be issued at a later date - there is no fixed timescale, a tribunal spokeswoman has told Estate Agent Today. Any request to the tribunal for permission to appeal following its decision must be made in writing within three weeks of the release of its judgement.

Agents’ Mutual, the parent company of the OnTheMarket portal, accuses the agency of breaking the terms of its contract by not adhering to the controversial 'one other portal only' rule and listing properties on multiple portals.

Gascoigne Halman, an 18-branch company operating in south Manchester, north east Cheshire and the High Peak, was acquired by Connells Group in October 2015 - prior to that, the agency had itself become a Gold member of OnTheMarket.
